Legal doctrine as human rights ‘practice’

Abstract ‘Practical’ approaches to human rights hold that analysis of legal must attend the practice(s) international law and nature justification is best determined by attending their role(s) in law’s system normative practices, not analogous moral outside it. These core tenets plausibly explain apparent normativity despite controversies about status many ‘rights’ ‘International Bill Rights’. Yet plausible practical require clear compelling accounts which practices qualify as practices. Most existing view ‘responses’ claims made name community key identification rights. Activities domestic governments non-governmental actors relevant While understandable, these ‘responsive’ practice create more problems than they solve. This work accordingly promotes a largely unexplored account on ‘human practices’ are strictly defined doctrine. ‘doctrinal’ most likely maintain rights’ potential benefits without generating an unduly expansive register or adopting strong theoretical commitments law.
